Terms and Conditions

These terms and conditions (Terms) govern your use of the Techcel Shop online store and every order you place with us. Please read them carefully, as they impose legally binding obligations on you and, in some instances, limit our liability to you.

These Terms should be read together with our Privacy Policy and our Returns and Refunds Policy, both of which form part of them. By placing an order you agree to be bound by these Terms.

1. Who you are dealing with

These Terms are an agreement between you and the supplier below, whose details are published in accordance with section 43 of the Electronic Communications and Transactions Act, 2002:

2. Your account

You may browse the catalogue without an account, but you must create one to check out, so that we can attach your order, delivery address and order history to you.

You are responsible for keeping your password confidential and for everything done under your account. Tell us immediately at sales@techcelshop.co.za if you believe someone else has used it. You confirm that you are at least 18 years old, or that you have the permission of a parent or guardian, and that the information you give us is accurate.

3. Products, pricing and availability

All prices are shown in South African Rand and include VAT where VAT applies. Delivery charges are calculated and shown separately at checkout before you pay.

Product images, descriptions and specifications are supplied to us by manufacturers and distributors. We make every effort to describe products accurately, but images are illustrative and packaging, bundled accessories and minor specifications can change without notice.

Stock availability reflects our suppliers' reported stock and can change between the moment you add an item to your cart and the moment you pay. If an item turns out to be unavailable after you have paid, we will contact you and offer a replacement, a delayed delivery, or a full refund of that item.

We take reasonable care to price our products correctly, but obvious errors happen. Where a price is clearly wrong — for example an item listed at a small fraction of its market value — we may cancel the affected order and refund you in full rather than fulfil it, in line with section 23 of the Consumer Protection Act.

4. Orders and when a contract is formed

Placing an order is an offer to buy. Your order is only accepted, and a sale concluded, once we have received your payment and sent you an order confirmation. Adding an item to your cart or reaching the payment page does not conclude a sale.

While your payment is pending we reserve the stock for your order. If payment is not completed, the reservation is released and the items return to general availability.

We may decline or cancel an order where the item is unavailable, where the price or description was clearly incorrect, where we suspect fraud, or where we cannot deliver to the address given. If we cancel an order you have paid for, we refund you in full.

5. Payment

Payment is taken through our payment provider's secure checkout. We do not receive or store your card number, CVV or banking credentials. Your order is confirmed once the provider has confirmed the payment to us.

Ownership of the goods passes to you once we have received payment in full. Risk in the goods passes to you on delivery.

6. Delivery

We deliver within South Africa. Delivery charges and estimated timeframes are calculated at checkout based on your delivery address and the items in your order.

Delivery timeframes are estimates given in good faith and are not guaranteed. They depend on supplier dispatch and on our courier partners, and can be affected by events outside our control. Where a delivery is going to be materially late, we will contact you.

Somebody must be available to receive and sign for the parcel at the address you gave us. If delivery fails because nobody was available or the address was wrong, further delivery attempts may be charged for. Please check your parcel on delivery and tell us immediately if it arrives damaged — see our Returns and Refunds Policy.

7. Cancellations, returns and warranties

Your rights to cancel, return goods and claim under a warranty are set out in full in our Returns and Refunds Policy, which forms part of these Terms. Nothing in these Terms limits the rights you have under the Consumer Protection Act, 2008 or the Electronic Communications and Transactions Act, 2002.

8. Acceptable use

You may not:

  • use the store for any unlawful purpose, or to commit or facilitate fraud;
  • attempt to gain unauthorised access to any account, server or system behind the store;
  • scrape, harvest or systematically copy our catalogue, pricing or content for commercial use without our written permission;
  • interfere with the operation of the store, or introduce malicious code to it;
  • place orders in another person's name or with a payment method you are not authorised to use.

We may suspend or close an account that breaches this clause.

9. Intellectual property

The Techcel Shop name, logos, site design, written content and photography are owned by us or used with permission, and may not be copied or reused without our written consent. Manufacturer names, product images and trade marks remain the property of their respective owners and are used to describe the products we sell.

10. Limitation of liability

We are liable to you for losses you suffer as a direct result of our breach of these Terms, up to the value of the order concerned. We are not liable for indirect or consequential loss, including loss of profit, loss of data, or loss arising from your inability to use a product, except where that liability cannot be excluded by law.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded — including your rights under the Consumer Protection Act.

We do not warrant that the store will be available uninterrupted or error free, and we may suspend it for maintenance.

11. General

These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them.

We may change these Terms from time to time by publishing the updated version on this page. The Terms that apply to your order are the ones published when you placed it.

If any provision of these Terms is found to be unenforceable, the rest of the Terms continue to apply. Our failure to enforce a right is not a waiver of that right.

Please raise any complaint with us first at sales@techcelshop.co.za. We would rather resolve it directly, and usually can.
